# Data Privacy and Security

> Data ownership, IP, confidentiality, storage and retention on Tamarind — including how the free tier differs

This page summarizes how Tamarind handles your data. The controlling documents are the
[Privacy Policy](https://app.tamarind.bio/privacy-policy) and the
[Terms of Service](https://app.tamarind.bio/terms-of-service); where this page and those
documents differ, those documents govern.

## Which terms apply to you

The Terms of Service cover the free tier only — if your organization has signed a separate
service agreement with Tamarind, that agreement governs your use instead. The Privacy Policy
applies to all use of the Service.

## Data ownership and IP

You retain all ownership and IP in your data and in derivatives of your data, including the
molecular inputs and outputs of the models you run. Data you generate through the Service is
yours exclusively; only you can file patents or seek other IP protection on it.

On the free tier, the Terms of Service additionally state that you grant Tamarind a
non-exclusive, worldwide, royalty-free license to use data you upload or submit **for the
purposes of operating and improving the Service**. That license does not transfer ownership,
and it does not permit the uses ruled out below — your data is still never sold and never
used to train models.

## Confidentiality

Confidential Data means data proprietary to your company: biological data such as sequences
and structures, model outputs and results, and your configured proprietary pipelines and
fine-tuned models.

* Your data stays inside Tamarind's cloud infrastructure and is not sent to servers outside
  the service providers listed below.
* Your data is never sold.
* Your data is never used to train models.
* Access is limited to employees, contractors, agents and advisors with a bona fide need to
  access it in order to provide the Service, who are bound by confidentiality obligations.
* Tamarind will execute a CDA or NDA with you. Email

No method of internet transmission or electronic storage is completely secure, so absolute
security cannot be guaranteed.

## Where your data is processed

Data is processed in the United States. If you are outside the US, submitting data to the
Service means it is transferred to and processed in the US. For personal data transferred
from the EU/EEA and Switzerland, Tamarind relies on the EU-U.S. and CH-U.S. Data Privacy
Frameworks.

Service providers that may process data on Tamarind's behalf, only to perform tasks for
Tamarind and under an obligation not to use the data for anything else: AWS, Microsoft Azure,
E2B, Modal, PostHog, Vercel, Front, Datadog, ClickHouse and Clerk. The full list, with links

## Retention and deletion

You can delete files and results yourself from your account page — see [Manage Files](/support/manage-files).

Personal data is retained only as long as needed for the purposes in the Privacy Policy, or
as required to meet legal obligations, resolve disputes and enforce agreements. Usage data is
generally retained for a shorter period.

If you stop using the Service, your account is deactivated and the data and results
associated with it are deleted on request. Email

retention schedule for your account.

## Your rights

If you are in the EU or EEA, you have data protection rights under the GDPR, including asking
what personal data Tamarind holds about you and asking for it to be removed. Email
[info@tamarind.bio](mailto:info@tamarind.bio); you may be asked to verify your identity
first. You also have the right to complain to your local data protection authority.

## What the free tier limits

The free tier may have limits on support, model availability and access to advanced features,
and the free tier or any part of the Service may change at any time. The limits are commercial
terms rather than data-handling terms — the ownership and confidentiality commitments above
are not among them.
